Is cannabis oil legal?
Is Cannabis Oil Legal?
Back to all articles
Yes and No! Most cannabis oils in the UK are legal but some are illegal. It all depends on the level of Tetrahydrocannabinol (THC) content.
VITO CBD Oil is legal!
There are different types of cannabis, which I will explain more about later, but in a nutshell CBD oil extracted from hemp cannabis which contains less than 0.2% THC making it completely legal. Whilst cannabis oils containing THC of 0.2% or more are illegal…it’s that simple.
The MHRA, the Home Office, and WADA all accept CBD Oil with less than 0.2% THC as completely legal and safe to use, giving people the reassurance and confidence to try CBD for themselves.
The reason for the years of confusion is a lack of knowledge of the different types of cannabis and the varying effects it can have.
Let me explain more...
CBD oil is legal in the UK.
The legal requirement for CBD Oil is that it contains less than 0.2% THC. THC is the psychoactive compound that makes users feel "high". With this tiny amount of THC, CBD has no psychoactive effects, so it’s impossible for you to get high.
CBD is extracted from the hemp plant which is a variety of the Cannabis sativa L. It has been bred specifically for the production of food, clothing and construction material. It also contains all the benefits of CBD but without any of the psychoactive effects.
By taking CBD you get to enjoy all the health benefits of cannabinoids but without the risk of breaking the law.
ILLEGAL CANNABIS OIL
However, Cannabis oil that contains THC at higher levels (more than 0.2%) is illegal in the UK. This type of cannabis is from the Marijuana plant, a completely different species to the hemp plant, with different compounds and completely different uses. Marijuana can contain up to 30% THC, which provides the psychoactive effects causing the ‘high’ feeling.
"Legalise Cannabis Campaign”
The press love to grab the publics’ attention with sensational headlines, which can often be misleading. Let’s not beat around the bush, there are different reasons why people want to legalise cannabis. For some it is fighting for the freedom to smoke marijuana to ‘get high’ without breaking the law. For many others, like the 12 year old boy, Billy Caldwell who suffers with epilepsy, they are campaigning for access to medical prescription cannabis to ease severe medical conditions.
But let’s not forget the thousands of people who are getting the benefits from the hemp cannabis plant in a legal and safe way from using CBD Oil with less than 0.2% THC content.
Unfortunately in order to sensationalise a story the media doesn’t always make a clear distinction between these groups.
Here’s what leading authorities have to say about CBD…
MHRA (Medicines & Healthcare products Regulatory Agency)
The MHRA is the Government department who are responsible for regulating all medicines and medical devices in the UK.
They have allowed the sale of CBD as a food supplement as long as no medical claims are made about it.
So sadly, we are unable to share any customer letters and their experiences of VITO CBD. We would be breaking the law if we made any health claims for our products.
World Health Organisation (WHO)
WHO have reported that Cannabidiol is one of several compounds of the cannabis plant. In November 2017 the WHO Expert Committee on Drug Dependence (ECDD) concluded that, in its pure state, cannabidiol does not appear to have abuse potential or cause harm.
World Anti-Doping Agency (WADA)
The World Anti-Doping Agency (WADA) who monitors the use of illegal substances in sport has removed CBD from the 2018 list of prohibited substances.
If an athlete is found to be using a banned substance they can be eliminated from events, stripped of their medals or even face a lifelong ban.
On this long list you can find many substances, one of them was cannabis. But after extensive research and animal studies WADA officially dropped cannabidol (CBD) from its list of controlled substances.
This is a major breakthrough for CBD users, allowing professional athletes to purchase and use Sport Certified and trusted CBD without risking their carers.
With increased awareness of CBD, that it is safe and legal, it is fast becoming the ‘go to’ food supplement. With better education and more clinical research being undertaken it is being finally recognised for its benefits. There has been a dramatic increase in the number of users in the UK and even high profile celebrities have openly admitted to taking it. Amongst them Jennifer Aniston, Olivia Wilde and Victoria’s Secret model Alessandra Ambrosio reveal why they use CBD to help them in their everyday life.
VITO CBD and the law
At VITO CBD the plant material we use is the Hemp strain of Cannabis Sativa L. The specific strain we planted this year is Futura 75, as this has been found to give the highest levels of cannabidiol with the lowest levels of THC, less than 0.2%.
We use the highest quality hemp and have our oil batches independently tested for quality, compound content and to ensure that we meet all EU regulations and requirements. With VITO CBD you can be confident that all our products are legal and safe.
